Terms of Service

1. Agreement to Terms
By accessing or using Tomato Visa (“Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users of the Service.
2. Description of Service
Tomato Visa provides a software-as-a-service (SaaS) platform that automates the process of monitoring and securing US visa appointments. Our platform uses robotic process automation (RPA) technology to interact with third-party visa scheduling portals on behalf of users who have explicitly authorized such access. We are an independent technology service provider and are not affiliated with, endorsed by, or operated by any government agency, embassy, or official visa scheduling system.

Upon receiving your visa portal credentials and payment, our automated systems monitor the applicable scheduling portal for available appointment slots that match your preferences, and book an appointment when a suitable slot is found. The visa appointment itself is provided free of charge by the relevant government authority; Tomato Visa charges only for the automation and monitoring technology we provide.

You expressly authorize Tomato Visa to access your visa appointment account solely for the purpose of monitoring and booking appointments as described. This authorization is limited to appointment-related actions only; we will never cancel an existing appointment without your explicit written instruction.
3. User Responsibilities
You agree that:
  • The credentials you provide are your own valid visa scheduling account credentials.
  • You will not use this Service for fraudulent, deceptive, or unlawful purposes.
  • You will not share one account's credentials with multiple users.
  • You will not attempt to interfere with, disrupt, or circumvent our systems or security measures.
  • Logging into your visa portal while our Service is active may cause the appointment page to fail to load. We recommend not accessing your account concurrently while our service is running.
  • You are solely responsible for attending the appointment we book for you and for completing all required visa application documents (such as the DS-160 form) independently.
4. Pricing and Payment
Service fees range from $49.99 to $79.99 per person and are determined dynamically based on demand and other factors at the time of your order. The exact amount will be displayed before you complete payment. All prices are in US Dollars and are inclusive of any applicable taxes collected by our payment processor.

Payments are processed by Paddle.com Market Limited (“Paddle”), our authorized reseller and merchant of record. When you complete a purchase, your transaction is with Paddle, not directly with Tomato Visa. Paddle handles billing, payment processing, and applicable tax collection in compliance with local regulations. Tomato Visa does not store your credit card or payment details. By completing payment you authorize the charge for the displayed service fee. This fee covers only our automation technology and is entirely separate from any visa application fees, embassy fees, or government charges; those remain your sole responsibility.
5. Refund Policy
You are eligible for a refund if you cancel before we successfully secure an appointment for you. To request a refund, use the self-service refund page at /refund or contact us at support@tomatovisa.io.

Payment processing fees are non-refundable. Our payment processor may retain a transaction fee when a refund is issued. This fee is not returned to us and therefore cannot be included in your refund. The amount credited back to your payment method may be slightly less than what you originally paid.

No refunds are issued after an appointment has been booked, as the service has been fully rendered at that point. If you manually book an appointment while our service is running, no refund will be guaranteed, as we cannot verify who booked the slot.

Approved refunds are processed within 5–10 business days to the original payment method.
6. No Guarantee of Appointment
Tomato Visa is a best-effort monitoring service. We do not guarantee that an appointment will be found or booked within any specific timeframe. Appointment availability depends entirely on third-party systems (the official US visa scheduling website) over which we have no control. Embassy policies, system maintenance, and geopolitical events may affect availability.

We are not responsible for delays caused by the unavailability of appointment slots, scheduled or unscheduled embassy website downtime, changes to embassy scheduling policies, or network/technical failures outside our control.
7. Account Security and Risk
You acknowledge and accept the following risks:
  • Providing your visa portal credentials to any third-party service carries inherent risk. We take reasonable security measures (see our Privacy Policy), but we cannot guarantee absolute security.
  • Automated access to the visa scheduling website may, in rare circumstances, trigger account-level security flags by the embassy or the scheduling system. Tomato Visa is not responsible for any resulting account restrictions, lockouts, or bans.
  • You remain solely responsible for your visa appointment account.
8. Prohibited Uses
You may not use the Service to:
  • Access accounts that do not belong to you.
  • Book appointments for profit-generating resale to others.
  • Circumvent, disable, or interfere with security-related features of the Service.
  • Use automated tools to abuse, overload, or scrape the Service.
  • Engage in any conduct that violates applicable law.
Violation of these prohibitions may result in immediate termination of your account without refund.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Tomato Visa and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or reputational harm, arising from your use of or inability to use the Service.

Our total aggregate liability to you for all claims arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tomato Visa and its officers from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law.
11. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Tomato Visa. You may not copy, modify, distribute, sell, or lease any part of the Service.
12. Termination
We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease. Sections 6, 9, 10, and 13 survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be submitted to good-faith mediation. If unresolved within 30 days, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English.

You waive any right to participate in class-action lawsuits or class-wide arbitration against Tomato Visa.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date at the top. Continued use of the Service after changes constitutes acceptance of the new Terms.
